The stmnt said that she had been “charged with the illegal performance of an abortion,” which has been a second-degree #felony since the state’s near-total #AbortionBan took effect in 2022. She was also charged w/practicing #medicine without a license.

Court records released late Monday indicated that a person who worked w/Ms. Rojas, Jose Ley, 29, was also arrested & charged w/the same offenses.

The 15-wk #AbortionBan had already been paused since Dec, when Reuss & other providers filed suit, which argued that the ballot measure, which adds constitutional protections for #abortion until about 24 wks, meant the ban was now #unconstitutional. #Arizona’s AG, Kris Mayes, had agreed not to enforce the ban while litigation played out.

The short ruling, from Judge Frank Moskowitz of #MaricopaCounty superior court, agreed the 15-wk ban was unconstitutional & forbade AZ ofcls from enforcing it.
