"Σύμφωνα με διασταυρωμένες πληροφορίες, η προανακριτική κατάθεση του συλληφθέντα Αφγανού, που κατηγορείται ως διακινητής και υπεύθυνος του ναυαγίου επειδή κρατούσε το τιμόνι, επιρρίπτει ευθύνες στον κυβερνήτη του περιπολικού σκάφους, ο οποίος, αντί να προχωρήσει στην άμεση διάσωση του μικρού και ευάλωτου φουσκωτού με τους 31 επιβάτες, ξεκίνησε να κάνει κύκλους γύρω από τη βάρκα δημιουργώντας επικίνδυνους κυματισμούς.

The juvenile court finally decided about their innocence. It is a scandal that these boys lost almost 5 years of their lives for the failures of the #EU and the Greek State.
Their lawyer Zacharias Kesses: A fair trial was finally held through an exemplary judicial process. An unthinkable miscarriage of justice was corrected, and three individuals—unjustly targeted and imprisoned for nearly four years—were unanimously acquitted. Justice prevailed.
H. W. added: "First of all, I would like to thank those who have supported us until today. After this trial, I want to have a very beautiful life and be able to shape my future. And I am so happy to have come out of this darkness into the light."

Aegean Boat Report:
Only hours after the catastrophic shipwreck on Lesvos that claimed 8 lives, 4 of them small children, Greek authorities arrested one of the passengers, a 20 year old Afghan man, and charged him of being a smuggler.
Only hours before, he had seen his wife and one of his children drown in front of him, helplessly watching, without him being able to rescue them, the worst experience imaginable. His other child was one of the survivors.
The 20 year old Afghan man explained in the preliminary hearing, that the real smugglers, who had stayed behind on the Turkish shore, as they normally do, had forced them to attempt the perilous crossing.

As deterrence, Greek authorities arrested the person who steers the boat, and he is charged with smuggling, endangering the other passengers lives, and if someone dies, their deaths. The court case is a farce, usually over in 15 minutes, no proper legal representation, many times without translations, so the accused don’t even know what is being said. A judge, more worried about what he will have for lunch, adds up the number of people onboard, multiplying it with the going rate of smuggling, and hands out a ridiculous prison sentences of 60-140 years.

Οι 3 από τους 6 που κατηγορούνταν για το κάψιμο της Μόριας και είχαν παραπεμφθεί στο δικαστήριο ανηλίκων αθωώθηκαν.
Με τα λόγια του δικηγόρου τους:
"8 Σεπτεμβρίου 2020. Πυρκαγιές καταστρέφουν ολοσχερώς τη Μόρια, τον μεγαλύτερο προσφυγικό καταυλισμό της Ευρώπης. Για αυτή την πράξη στοχοποιήθηκαν έξι νεαροί Αφγανοί — πέντε εκ των οποίων ανήλικοι. Χωρίς επαρκή στοιχεία, διασύρθηκαν, θυματοποιήθηκαν, κατηγορήθηκαν για όλα. Το τεκμήριο αθωότητας ποδοπατήθηκε.
Ακολούθησαν δίκες που απείχαν πολύ από το να χαρακτηριστούν δίκαιες.
Χθες, το Τριμελές Δικαστήριο Ανηλίκων Μυτιλήνης μετά από πολύωρη υποδειγματική διαδικασία αθώωσε ομόφωνα τους τρεις εντολείς μου.
Μετά από 3 χρόνια, 5 μήνες και 22 ημέρες άδικου εγκλεισμού σε φυλακές ενηλίκων.
Μετά από 1.662 ημέρες σε πλήρη δικαστική ομηρεία.
Η υπόθεσή τους θα μείνει στη μνήμη μου ως μία από τις πιο χαρακτηριστικές αποτυχίες του συστήματος να προστατεύσει έγκαιρα αθώους.
Η υπεράσπισή τους αποτελεί για μένα τίτλο τιμής."

"18 νεκροί χθες σε δύο διαφορετικά ναυάγια βόρεια της Λέσβου.
Οι ΔΟΛΟΦΟΝΟΙ του ελληνικού λιμενικού σύμφωνα με τις πρώτες μαρτυρίες των επιζώντων προκάλεσαν με τον πιο ΑΜΕΣΟ τρόπο, μέσω ενός ακόμα εγκληματικου pushback, τη βύθιση του ενός πλοίου.
Άρα καθεστωτικά (ή και πολλά 'προοδευτικά') μίντια, το μόνο που θα ειπωθεί, αν ειπωθεί κάτι, είναι ότι 'έγινε κάποιο ναυάγιο', 'φταίνε οι διακινητές', 'το λιμενικό έσωσε τους επιζώντες'.

Eνόχους έκρινε έξι κατηγορούμενους για το αδίκημα της παράνομης οπλοφορίας και της παράνομης βίας από κοινού, επιβάλλοντάς τους συνολικά 16 μήνες ποινή φυλάκισης στον καθένα με αναστολή τριών ετών, καθώς και δήμευση των κατασχεθέντων και έξοδα δίκης. Παράλληλα, οι κατηγορούμενοι απαλλάχθηκαν από τις κατηγορίες της επικίνδυνης σωματικής βλάβης, της απρόκλητης φθοράς και της κλοπής.

The Aegean graveyard has claimed 8 more innocent lives.
Greek authorities state, as they always do, that the responsibility lies on the "ruthless smugglers in Turkey", who placed these people in a “floating Coffin”. Even before an investigation has taken place,they have already made up their conclusions, also not unusual, since these shipwrecks are never properly investigated by independent bodies.
We register that one of the vessels involved in the rescue operation, a Lambro 57, ID number ΛΣ-602, its crew notoriously known for its extreme violent behaviour towards refugees, involved in numerous documented violent pushbacks in the area for years, ramming rubber boats, shooting towards people, towing boats back to Turkey, and forcing people violently into life rafts at sea. Perhaps this was the vessel “on patrol” and “detected” the boat last night?
From the footage published of the rubber boat, the bottom is torn off from the front and all the way to the back on the right side, could this damage have been the result of something other than poor quality of the boat, like a heavy impact caused by a collision?

Ναυάγιο με πρόσφυγες σημειώθηκε τις πρωινές ώρες της Πέμπτης στη θαλασσια περιοχή ανοιχτά της Σκάλας Σκαμνιάς.
UPDATE : Συνολικά έχουν εντοπιστεί επτά νεκροί αφγανικής καταγωγής. Συγκεκριμένα 3 γυναίκες, 1 άνδρας, 1 αγόρι και 2 κορίτσια.
Πληροφορίες αναφέρουν ότι αγνοείται 1 ακόμη παιδί
Μέχρι τώρα έχουν διασωθεί 23 πρόσφυγες.

A.B. was accused of "smuggling" or "boat driving". Despite a video showing him as a passenger, he waited five years for his trial, with a potential 60 year sentence looming over him. We are relieved by yesterday's decision, but will continue fighting against criminalization of people on the move.

Two other "boat driver" cases were tried in #Mytilene yesterday. The two defendants were convicted and sentenced to over 100 years each. These convictions are a stark reminder that A.B.'s acquittal is the exception rather than the rule. #Criminalisation of #migration must end!
