Por Luis Muñoz No todas las personas que son liberadas después de purgar una condena tienen oportunidad de conseguir un empleo que les ayude a su inserción en la sociedad y les asegure igualdad de oportunidades y puedan participar plenamente en la vida social, económica y cultural del país.Este proceso de inserción busca eliminar barreras y promover la igualdad de acceso a servicios y derechos para todos, especialmente para aquellos en situación de vulnerabilidad, pero no es fácil.La diputada Rebeca Peralta León después de analizar el tema concluye que en México “la realidad es cruda”, ya que de acuerdo con el INEGI, solamente 3 de cada 10 personas liberadas consiguen un empleo formal.Rebeca Peralta León, Observa que las barreras que impiden la contratación de las personas recién excarceladas son tan reveladoras como dramáticas, pues el 58% de los liberados carece de identificación oficial vigente y el 83% de los empleadores manifiestan rechazo a contratar personas con antecedentes penales.Un círculo vicioso que es preciso romper si se quiere lograr el objetivo planteado por la diputada Rebeca Peralta.En ese sentido, la legisladora del Partido Verde en el Congreso de la Ciudad de México presentó una iniciativa para otorgar un estímulo fiscal, vía el impuesto sobre la renta (ISR) a las empresas que contraten o tengan en sus nóminas a personas recién liberadas del sistema penitenciario en México; eso sería un paso hacia su reinserción social y reducir la reincidencia delictiva en el país, sostiene.En su propuesta ante el Congreso destaca la importancia de reformar el artículo 186 Bis de la Ley del Impuesto sobre la Renta, al afirmar que “cada peso invertido en la reinserción laboral se traduce en ahorros significativos para el Estado por la reducción de los costos asociados a la delincuencia y la prisión.Peralta León lamentó las carencia de estas personas porque no solo truncan sus oportunidades de reintegrarse a la sociedad, sino que alimenta un círculo vicioso de exclusión, desempleo, economía informal y reincidencia delictiva.El Diagnóstico Nacional de Supervisión Penitenciaria revela que un alarmante 78% de los liberados no encuentra empleo formal en su primer año de libertad. Esta cifra no es solo un número; es un reflejo de vidas truncadas, familias desamparadas y una sociedad que clama por soluciones.Desde la tribuna del Congreso, la diputada Peralta León dijo que a nivel internacional los incentivos fiscales para promover la contratación de personas liberadas del sistema penitenciario han demostrado ser una herramienta efectiva en la reducción de la reincidencia delictiva y el fomento de la inclusión laboral.En Estados Unidos, por ejemplo, el programa Work Opportunity Tax Credit (Crédito fiscal por oportunidad laboral), ha generado impactos significativos. Desde su implementación en 1966, este esquema ofrece a las empresas un crédito fiscal de hasta $2,400 dólares por cada persona liberada que contraten, resultando en aproximadamente 48,000 empleos anuales para este sector vulnerable y la tasa de reincidencia disminuyó en un 22% en promedio.Alemania, a su vez, destaca por su enfoque de “empresas sociales” que reciben exención total de impuestos cuando al menos 30% de su plantilla laboral está compuesta por personas en proceso de reinserción, agregó.En Chile el gobierno ha implementado con éxito el programa “Libertad Emplea”, que ofrece triple deducción fiscal por las contrataciones de personas liberadas.
